Woman Obtains $60,000 for Slip and Fall Case

A woman in Southaven recently won her slip and fall case against the hospital where her husband was being taken care of. Brenda Dowland won 75 percent of the damages she was seeking and 25 percent for negligence, bringing her total award monies to $60,000.

Dowland was visiting her husband at Baptist Memorial Hospital-DeSoto when she slipped on a wet spot of the hallway near the gift shop. That portion of the tiled floor had recently been mopped by a hospital employee; the only warning sign nearby was located at the other end of the hallway where Dowland would not have been able to see it.

Due to her fall Dowland told the court that she suffered injuries to her right arm that are the reason why she is still in pain management today. The hospital argued back that not only did they have a warning sign posted, since she was not a patient of the hospital but only a visitor, they did not have any duty to her to keep their premises safe.

The jurors of DeSoto County unanimously disagreed.
