Family Plans to Appeal Wrongful Death Ruling

In the city of Minneapolis, reports indicate that a family of a teenager who was shot and killed by a police officer in the state will be appealing their wrongful death lawsuit to the Supreme Court.

Allegedly, 19-year-old Fong Lee was hanging out with friends riding bikes near North Minneapolis Cityview Elementary School when a group of officers from Minneapolis Police Department chased them across the playground. During the case, Officer Jason Andersen testified that Lee was carrying a gun and refused to drop it despite police orders.  So, Andersen said he was forced to shoot him.

Lee was shot eight times in his back inside and five times in his chest.  The 8th U.S. Circuit Court of Appeals ruled that the evidence supported the jury's initial verdict and that the officer did not use excessive force when he shot and killed Lee. The court also ruled that Lee's family had received a fair trial, but the family disagrees and has plans to file an appeal alleging police misconduct.
