Courthouse Hears Two Medical Malpractice Cases

The Erie County Courthouse has seen the second of two medical malpractice cases won in a span of a few days.

Last week a jury awarded $1.8 million to the family of a woman who died of lung cancer back in 2005. However, that amount is expected to be reduced to $1 million if a settlement is reached with the jury. Her estate filed the suit against doctors in Kane and Erie who failed to diagnose and treat Carolyn Champlin's cancer. The two doctors were found guilty of this negligence - Renato Ocampo, M.D., and Wilfredo Tan, M.D. - and will now be forced to pay the settlement.

It was later reported that Tan had already settled with the state but was still listed as a defendant on the verdict slip. This piece of paper also revealed the opinion of the jury that Ocampo be named responsible for 60 percent of the blame, with 40 percent attributed to Tan. On the part of Kane Community Hospital, no blame was attributed.

Judge John Garhart oversaw the trial.
