Family Sues Yamaha for 10 Year Old's Death

When tragedy struck a family in Warren County in 2007, they decided to strike back against the people they believe to be responsible for causing it.

The family of 10-year-old Ellie Sand is suing Yamaha for her death that was caused when she was thrown from a Yamaha Rhino side-by-side vehicle. The young girl was with her family at a church picnic where they were offering rides in the side car.

Now lawyers for Yamaha and the Sands family will meet at the Warren County Common Pleas Court for a two-week civil trial to determine the outcome of this lawsuit. They are asking for $20 million for the wrongful death of Ellie.

Part of their case will revolve around the statistic that Ellie's death the 26th fatality listed while using a Yamaha Rhino side car. In total 94 people have died due to accidents with the Rhino and 1,190 injuries have been reported, according to the court documents filed by Sand's attorney Mike Roberts.

Included in the lawsuit are Clinton County Motor Sports and Let It Gro LLC, the owner of the Rhino and host of the picnic.  They hope to get no less than $10 million in compensatory damages and no less than $10 million in punitive damages.
