Family Alleges Negligence Led to Loved One's Death

After falling down a staircase to her eventual death, the family of 89-year-old Carrie Delay is now seeking legal action.

Delay was a resident at the Motion Picture & Television Fund's nursing home when she fractured her spine and caused other injuries that led to her death a week later. The Delay family is now suing for negligence since the nursing staff failed to properly monitor Delay, a wheelchair-bound Alzheimers patient, who should not have been anywhere near the stairs.

Although the specific amount is unknown at this time, the Delay family is asking for punitive damages for wrongful death, nursing home negligence and elderly abuse. The lawsuit was filed in the Los Angeles Superior Court in Van Nuys last week. While this isn't the first time the charity has come under fire the Delay case does represent their most serious incident to date. They were recently fined $10,000 by the California Department of Public Health for multiple failures to prevent a patient from falling in the Alzheimer's unit.
