Officers Looking into Failure to Yield Accident to Determine Fault

A state representative is in trouble with police after getting involved in an auto accident that led to a fatality. Even though the other driver was intoxicated and the representative was not, he failed to yield to the other driver when the collision took place. According to news sources, the state representative was driving and crossed the center line of an intersection when he hit the second vehicle.

When police arrived on the scene they spoke with several witnesses. All of them stated that the victim was not driving erratically and was in his own lane when the incident occurred. However, when a toxicology report was completed on the 54-year-old victim, his blood alcohol level was high. He was found to have a BAC of 0.29 percent, well above the state limit of 0.08 percent. Police now have to determine whether the accident could have been avoided if the victim had not been intoxicated. At this time, no charges have been filed against the representative.
