In Ohio, it is reported that a former assisted living facility worker has withdrawn her guilty plea and will now stand trial. The worker, Iindia Weatherly was accused of nursing home abuse after an 87 year old man fell and broke his hip three weeks prior to his death, which occurred last summer.
Weatherly was charged with a fourth-degree felony and if she is convicted by a jury she will face a six to 18 month prison sentence.
In court, Weatherly admitted that she had been careless, but she denied that she had any intention of causing the victim harm. Witnesses said that Weatherly pushed a kitchen door open, which hit the 87 year old and caused him to fall. Witnesses also said that while the man was on the ground, Weatherly punched him.
A coroner ruled the elderly man's death as a homicide, but prosecutors cannot prove that the incident caused his death.

New reports indicate that a slip and fall case settled on June 11th. The case against Jazz Casino Company LLC had been set for a one-day bench trial in Orleans Parish Civil Court District on June 28th. However, a letter was sent by the plaintiff's attorney to Judge Paulette Irons announcing a settlement.
Prior to the settlement, Melinda Abbey had filed a lawsuit against Jazz Casino Company LLC because she said she was involved in a slip and fall accident while at Harrah's Casino in downtown New Orleans. In June 2006, she filed a petition against the casino to seek monetary damages for her injuries.
Abby said that she "sustained injuries to her back, right hip, left hand, ankle and neck". She also said that permitting a dangerous condition and/or defective condition to exist on the floor of the premises, the casino was liable for her injuries.
In November 2006, both Abby and the defendants agreed to a stipulated protective order. The order stated that the parties mutually agreed to allow certain documents produced by the casino to remain private and confidential.
At this time, the amount of the settlement has not been disclosed.

In San Francisco, two people had to be hospitalized for dog bite injuries. The individuals were attacked at Golden Gate Park on July 1st at 6:42 AM.
Animal Care and Control officials report that they seized two dogs. However, they believe that only one (an unneutered male pit bull) was connected to the attacks. While trying to catch the pit bull, officers had to fire two shots from their guns and hit the animal in its face. The other dog that was captured was identified as a female shepherd mix.
Bela Martin, the first victim, had to be rushed to San Francisco General Hospital after suffering dog bites to her lower legs. She is reportedly in fair conditions. The second victim, a male in his 40s, had to be taken to UCSF Medical Center. He also sustained bites to his legs.
At this time, a veterinarian is treating the pit bull. The dogs' owners may face civil, criminal and/or administrative charges as all male pit bulls must be neutered in the city.

| Family of Man Killed by Nursing Home Negligence Awarded Nearly $5 Million |

The family of a man killed by a morphine overdose has been awarded nearly $5 million. The victim, Burr Needham, was checked into Mercy Memorial Nursing Center in April 2002 to receive physical therapy for a non-displaced hip fracture, but was found dead only a week and a half later from a morphine overdose.
The medical examiner ruled Needham's death a homicide, leading the man's family to hire nursing home negligence lawyers. The ensuing investigation revealed that the nursing home staff had failed to monitor the amount of morphine given to Needham and had not recorded that any morphine was given to him on his medical chart. The trial lasted over three weeks, but in the end, Needham's family was awarded nearly $3 million for loss of companionship, $1.5 million for pain and suffering, and $350,000 for damages and lost valuables.

| Survey Shows Doctors Overtreat to Avoid Malpractice Suits |
| Posted By Lanier Law Group |
 |
According to a recent survey, over ninety percent of doctors say that they overtest and overtreat as a way to protect themselves from medical malpractice lawsuits. The findings of the survey aligned with another published by the Associated Press that found that emergency room doctors overtreat in order to avoid malpractice suits.
The survey asked simply, "Do physicians order more tests and procedures than patients need to protect themselves from malpractice suits?" and, "Are protections against unwarranted malpractice lawsuits needed to decrease the unnecessary use of diagnostic tests?" Not surprisingly, ninety-one percent of doctors answered "yes" to both statements.
Dr. Tara Bishop found the results to be quite accurate. She said, "When you sit around at a dinner party with doctors, malpractice fears and a kind of hatred of the malpractice system really comes up as a common theme." Overtreatment costs the US healthcare system billions of dollars every year.

| Transplant Patient Gets HIV from Infected Kidney |
| Posted By Lanier Law Group |
 |
|
In Orlando, Florida, a woman that became infected with HIV after receiving a kidney transplant is planning to file a medical malpractice lawsuit against Lee Memorial Health Systems. According to the plaintiff, 55 year old Karen Cruz, the health care facility was negligent and deviated from the standard of care.
Cruz said, "Everybody in dialysis waits and dreams when you get the call that says we got a kidney for you. But the greatest gift is to get a live kidney from a donor." On August 29th, Cruz went to Southwest Florida Regional Medical Center to undergo transplant surgery. For her, the transplant had been long awaited. Never in her wildest dreams did she expect what would happen following the organ transplant.
According to Cruz's personal injury lawyer, the donor's blood was tested for HIV and other diseases on August 14, 2007. On August 24th, the tests came back positive for HIV, yet doctors allowed the transplant o take place.
In 2009, Cruz's lawyer contacted her and told her about the results of the blood test. Based on the test, it was assumed that Cruz might have become infected with HIV. It was later revealed that Cruz was, in fact, HIV positive.
Cruz told news sources, "I have not been able to enjoy not one minute of life since I got off that operating table. I have been so sick, it's unreal… It makes it very difficult to trust any doctor for me. I would have to be on my deathbed to say yes to any surgery today." In order to stay alive, she says she must take at least 20 pills a day.
At this time, she is seeking monetary compensation from the medical facility to cover her current and future healthcare costs. Her medical bills exceed $100,000, but in the state of Florida, medical malpractice claims are capped at $100,000.

| Joe Jackson to File Wrongful Death Claim |
| Posted By Lanier Law Group |
 |
News sources report that Joe Jackson is going to file a wrongful death claim against his son's physician, Dr. Conrad Murray. Recently, Jackson's attorney sent a document prerequisite to filing a wrongful death lawsuit to the doctor. In the paperwork, the attorney asserts that the doctor consumed alcohol hours before he administered Michael Jackson with a lethal dose of Propofol, an anaesthetic. After the drug was administered on June 25, 2009, the pop star died.
Joe Jackson's lawyer wrote, "Prior to treating Michael Jackson, (the) defendant was at a strip club called Sam's Hofbrau in Los Angeles where he had been drinking." He said that it was reckless for the doctor to drink alcohol before treating Jackson and also said that Murray concealed his conduct from the legendary singer.
In the lawsuit, Joe Jackson has asked that his lawyer list the medical conditions that his son suffered from due to the drugs that Murray administered. He believes that his son suffered from "neurological, pulmonary, and anaemia signs over several weeks prior to his death." It is asserted that the signs were obvious, but ignored by Murray who continued to give Michael drugs.

When people file premises liability claims and they are successful, meaning they win an award or settle their cases, they can receive damages for their medical bills, lost wages, future lost wages, trauma and pain and suffering.
In order for people to be eligible to file claims, they must be able to prove a few things. First, they must be able to prove that a dangerous condition existed on the other person's property. Second, they must prove that the person know the dangerous condition existed and did nothing to correct it (this is called proving negligence). Finally, people must be able to prove that because the person was negligent, they suffered injuries.
All of these elements are crucial in the success of any premises liability claim. However, they can be very difficult to prove without help from a North Carolina personal injury lawyer, like the lawyers at the Lanier Law Group. If you have been injured while visiting another person's property, contact our law office now!

According to NBC news, the conditions discovered after surprise investigations in an Illinois nursing home were found to be not only disgusting, but deplorable. The state decided to conduct an investigation of one nursing home that yielded 37 pages of nursing home violations.
Reports revealed that patients within the home were left in soiled beds and that many linens were not only thin, but also stained brown. Many of the residents' hair were found to be greasy and unclean, too. Aside from neglecting patients, the nursing home was not administering medications correctly and medical records were kept in boxes that were soaked with water.
The facility housed 79 residents and employed 90 nursing home staff members. However, after the investigation concluded, the state shut the facility's doors due to the nursing home negligence that had been ongoing.

According to Robby Price, he was just 14 years of age in 1999 when a Catholic Priest sexually abused him in Charlotte, North Carolina. Eight years following the abuse, he kept his mouth shut and told no one of his dramatic ordeal.
He told news sources that while he suffered in silence, he endured flashbacks and painful nightmares. His past abuse was weighed so heavily upon him that he often through of committing suicide. These feelings prompted Price to take legal action against his molester.
This past Friday, Price secured a great victory after the Roman Catholic Diocese of Charlotte announced that it would pay him a $1 million settlement. The priest that abused Price, Reverend Robert Yurgel, has since been imprisoned.
The Diocese set aside $47,500 to pay for Price's counseling, therapy and medication over the next five years. During Yurgel's sentencing, Price had a chance to speak out. He said to the former priest, "You are a liar, a thief of childhoods and a child molester." Price says that he is starting to feel closure at this time.

| North Carolina Ranks #6 for Most Tractor Trailer Truck Accidents |
| Posted By Lanier Law Group |
 |
Recently, ABC11 ran a significant story about the number truck accidents that occur nationwide. According to the news station, the state of North Carolina ranks number 6 for the most tractor trailer accidents. ABC11 says that in 2009, more than 50 percent of trucks in North Carolina received either safety or maintenance violations. Approximately 12% of trucks were so poorly maintained that they had to be put out of service.
When you think about it, the figures are quite startling as thousands upon thousands of trucks are driven on North Carolina streets and highways. If 50% of the trucks that are on the road in the state are poorly maintained or even defective, major accidents are very likely and could easily lead to the injuries and deaths of innocent people.
The Lanier Law Group hopes that the state of North Carolina will crack down on trucking companies and drivers who are violating safety and maintenance laws so that innocent people are not harmed.

| Historic Healthcare Legislation is Passed & Signed into Law |
| Posted By Lanier Law Group |
 |
On Sunday, the House passed an extensive-health care bill that will completely overhaul the current health care system in America. Today, the Senate passed a companion bill, sending it back to the House for final approval. House Speaker Nancy Pelosi said the bill should have enough votes to pass. As long as the House approves the bill, President Obama is expected to sign it into law.
On Tuesday, President Obama signed the overall health care bill, which will assure that 32 million Americans will be able to receive health insurance coverage, made possible by subsidies, employer obligations, and a mandate for most Americans to carry insurance.
Some features of the legislation include:
- Raising taxes (mostly on the wealthy) to reduce future Medicaid spending by $500 billion.
- Protecting Americans from losing their insurance coverage due to an illness or sickness
- Insurance companies would not be able to deny people coverage for a pre-existing condition. They also will not be allowed to charged people with pre-existing conditions more money.
- Most Americans will be required to carry health insurance, either from their employer, a government program, or by buying their own policy directly from the insurance company. Anyone who fails to carry insurance will face penalties from the IRS.
- Insurance companies will be prohibited from putting lifetime dollar limits on policies.
- College students can stay on their parents insurance policies until they are 26.
- Tax credits will be offered to help working families pay for coverage they otherwise could not afford.
- If adult children (people ages 18-26) have access to an insurance plan through their employer, they would not be eligible to stay on their parents’ insurance. However, if they get married they could still remain on the insurance policy until they turn 26.
- It will close the prescription coverage gap for seniors and improve preventive care.
Although this is a historic moment, it is expected to take 4 years before the effects of the legislation are felt. But once all is said and done, the number of Americans without insurance will drop by over 50%, and those Americans who want to keep their current insurance policy will be able to do so.

| Lawsuit Filed Over Cleveland Home Explosion |
| Posted By Lanier Law Group |
 |
A class action lawsuit may soon be filed in connection with a January 25 Cleveland home explosion that damaged 57 buildings nearby.
A lawsuit was filed against Dominion East Ohio Gas Co. and EZ Access Funding, an investment company based in California. The lawsuit is blaming the two companies for a gas leak that resulted in a home explosion.
According to the lawsuit, EZ Access ignored its responsibility to maintain the home, which has been vacant since last summer. The lawsuit also alleges that Dominion failed to ensure the gas was shut off after residents complained they could smell a natural gas odor four days before the explosion.
Gerald Walton, the attorney representing EZ Access, said his client is not to blame for the explosion. He said his client was completely unaware that utilities were being supplied to the home and that they never authorized the gas or any other utilities to be turned on.
Attorney Scott Kalish is representing the owners of three of the homes that were damaged, as well as a dozen other people who rent properties in the area. He believes there could be up to 60 additional property owners and 80 additional renters affected by the explosion. He also says that four people suffered minor injuries in the blast.
Kalish is hoping to classify the lawsuit as class action.

| How Much is a Personal Injury Claim Worth? |
| Posted By Lanier Law Group |
 |
If you have recently suffered an injury due to malpractice or negligence, you are probably wondering whether or not you have grounds to file a lawsuit for compensation. You are also probably wondering how much your personal injury claim is worth. This is a question we get asked a lot, and it’s always a difficult one to answer without having reviewed the facts of your case.
The biggest factor that is taken into consideration when determining how much a case is worth is the extent of your injuries, and they will affect your life in the immediate future and in years to come. Naturally, claims involving minor injuries are worth less than claims involving serious injuries, such as amputations, permanent disability, brain injuries, paralysis, etc. Other factors that are often taken into consideration include:
- If there was any property damage
- Which person or persons is at fault for the accident
- The degree to which each person involved was at fault
This last point is important. North Carolina is still a contributory negligence state, which means that if you are even partially at fault for the accident you will be extremely limited in the amount of compensation you can recover.

| Contributory Negligence v. Comparative Negligence |
| Posted By Lanier Law Group |
 |
If you have suffered an injury due to another person’s negligence in the state of North Carolina, it is important to understand the difference between contributory negligence and comparative negligence.
Comparative Negligence
The majority of states operate under comparative negligence. This means that if someone is injured as the result of negligence or malpractice they have the right to be compensated for their injuries, pain and suffering, medical expenses, lost wages, and property damage, even if they contributed to the accident in some way.
In these types of personal injury cases, the court will look at the percentage to which each party is at fault. If you were found 20% at fault and the other party was found 80% at fault, the defendant must compensate you for 80% of your losses.
Contributory Negligence
Accident and injury victims in states that operate under contributory negligence statues are limited to the amount of compensation they can recover. Unfortunately, North Carolina is one of the few remaining contributory negligence states in the country. This means that if you are even slightly at fault for the accident or injury, you cannot recover any compensation in a North Carolina personal injury case.

At Lanier Law Group, we know the negligence laws are harsh, and are therefore even more driven to help our clients recover as much compensation as possible.
