Workers' Compensation Benefits

When a person is injured at work or as a result of the job duties he or she was required to perform,  he or she has the option of filing for financial benefits through the North Carolina workers' compensation system.  Any person who suffers an "injury by accident" at work, or who suffers from an occupational disease will be eligible to seek benefits under the Workers' Compensation Act.  

What Do Workers' Compensation Benefits Entail

Workers' compensation benefits cover the cost of any medical expenses associated with treating your injuries, as well as a portion of your lost wages (2/3 of your average weekly wage).  You may also be entitled to additional benefits, such as a disability rating for compensation or loss of a body part or disfigurement.  However, be aware that if you are receiving Social Security benefits, long-term disability benefits, or some other type of compensation for your disability, there may be an offset or reduction in your benefits if you are also receiving workers' compensation benefits.   Furthermore, if a family member was killed while at work, you may be entitled to death benefits.  An attorney at Lanier Law can provide you more information about this.

If you file for benefits through the workers' compensation system, your employer is responsible for paying your medical expenses and has the right to direct your medical treatment. This means your employer may choose your doctor.  You do, however, have the right to ask the Industrial Commission for permission to see a doctor of your choosing.  It is very important that you get permission first before you see a doctor.  If you are treated by your own doctor without getting permission from the Industrial committee, you may jeopardize your benefits.
