A man from Cleveland County was involved in an accident with a truck when riding his motorcycle early in the morning. According to the police report, the 21-year-old motorcycle driver got into the accident when the truck turned in front of him. The motorcycle struck the truck and the man flew off into the road. The driver of the truck immediately went to assist the injured man who was lying in the road. He never had time to help; a tractor-trailer ran over the motorcyclist as he was in the middle of the road.
Authorities report that the diver of the tractor-trailer did not see the injured motorcyclist in the road because of the lack of light during the early morning and therefore did not have enough time to stop to avoid hitting the injured man. The police do not believe that speed was a factor in the incident. The driver of the truck who pulled out in front of the motorcyclist is being charged with misdemeanor death by vehicle. There is no current information if the driver of the tractor-trailer will also be responsible for the death of the motorcyclist.
In this case, the truck driver may be found at fault because he turned into oncoming traffic before it was clear to do so. The family of the motorcycle driver could file a wrongful death lawsuit against the truck driver. Lanier Law Group, P.A. helps individuals and families whose loved ones were killed due to negligence.
