Couple Face Murder and Elder Neglect Charges

A Napa couple facing trial for elder abuse allegations have postponed entering a plea while attorneys consider whether a transcript of testimony should remained sealed for the duration of the trial.

Tony and Mary Heinricher face murder and elder neglect causing death counts following the death of Tony Hinricher's mother, 92-year-old Marilyn Heinricher. Marilyn Heinricher fell while in her son's front lawn and was only brought to the hospital by the couple two weeks after the incident occurred. She later died from complications caused by the fall.

The couple was indicted by a Napa County grand jury following a September hearing.

The couple's respective attorneys requested that a transcript of the grand jury hearing remain sealed, claiming the information in the hearing would jeopardize Mary and tony Heinricher's right to a fair trial.

The document will legally become public after ten days. Presiding judge Mark Boessenecker will decide whether to extend the sealing order on a hearing set for Friday.
