Texas Wal-Mart Named in Slip and Fall case

When Results Matter Most, Hire a Heavyweight

Like many stores, Wal-Mart is outfitted with slippery linoleum that can be slick when wet. In a store with lots of food products and liquids, spills happen quite frequently. Employees are responsible to clean up these messes as soon as possible so that people don't end up falling on water that dripped from fresh flowers or tomato sauce from a cracked jar. They are also supposed to place a bright orange or yellow warning sign in front of the spill until someone can attend to the mess with a mop, and leave that sign there until the water has dried.

Unfortunately, one Wal-Mart in Texas didn't get to their mess soon enough. Two years ago, Laura Cervantez says that she slipped and fell on a slimy substance that was left all over the floor. She is now after the store, and also listed the Wal-Mart store manager in her claim. Cervantez is seeking damages and court costs from the injuries that she injured as a result of the slip and fall. She believes that the store was negligent in their efforts to keep the floors safe and clean. She also believes that the Wal-Mart has premises liability to provide for her pain.

This is not the first time that a Wal-Mart has been sued for leaving slippery substances on the floor. It certainly won't be the last. We live in a litigating society, where many people sue for personal injury faults.
