Our client was traveling west on a motorcycle, came to a stop at a stop sign and was going to make a left turn. The defendant was traveling east, came to a stop at a stop sign and was going to make a right turn. Both drivers thought the other was allowing them to make the turn first. Both proceeded into the intersection and collided. The police officer could not determine fault. Our client suffered from knee abrasions, bilateral rib fractures, pneumothorax, a right shoulder fracture that required surgery and a right wrist fracture. The other drivers’ insurance carrier denied liability. We filed a lawsuit; the insurance company overturned their decision, and we recovered all applicable insurance coverage.

After the collision, the defendant continued into oncoming traffic, left the roadway and collided with another vehicle before colliding with a building. She underwent emergency surgery and was hospitalized for five days. A massive dosage of insulin was intentionally administered to kill our very sick 60-year-old client who was on dialysis, heavily medicated, and suffering from renal failure. The nurse was prosecuted and convicted. At the time, NC had a damages cap of $656,730. We had to show punitive damages and achieved a cap buster, beating the cap of non-economic damages on med mal cases.

Medical Malpractice Overdose Death
Our 6-year-old client had issues wetting his bed. His parents consulted a doctor who prescribed Imipramine, a strong psychoactive medicine sometimes used for bed wetting with a known risk of cardiac side effects. Our client was playing on the playground at school and died in front of his sibling and classmates after suffering a cardiac arrest. The toxicology results showed the child was prescribed 9 times the recommended dosage for our client’s weight.

Birth Injury
Our 14-year-old client hid an unexpected pregnancy from her family and did not receive prenatal care until the 17th week. After a difficult delivery where the baby had the umbilical cord wrapped around its neck and a suction vacuum was used, the baby was born with significant developmental delays. This was a hotly contested case as the opposing counsel’s experts testified that the developmental delays were a result of bacterial exposure in the birth canal. This was a compromise settlement of a case that would be difficult to win at trial. We were able to secure a sizeable settlement, and the money went into a special needs trust to help with baby’s significant care needs.

Our 11-year-old client was at swim practice when a utility pole fell near the pool at her swim club. The utility pole fell because it was in a state of disrepair. The massive electrical current jumped to the plumbing for the pool which was not properly grounded. The swimmers felt a charge in the water. When the lifeguard called the children out of the pool, or client used the metal ladder to exit and was electrocuted as her coach, peers and parents watched helplessly. We sued the utility company and the swim club.

Our client was employed as a truck driver and sent to a distribution location to pick up two trailers. Once he arrived on the premises, he was attempting to connect the two trailers with a dolly. Our client suffered a crushed hand injury that required multiple surgeries.

Our client had made a delivery to an upstairs apartment unit. As she was walking down the stairs, she was holding the handrail and looking down at the steps since the stairwell was very dark. An oddly shaped cement block was at the bottom of the stairs, which our client could not see due to the poor lighting conditions, causing her to trip and fall.

While walking through the service department to the retail area of a car dealership, our client slipped and fell when he stepped in liquid on the floor. The masseuse did not have assets or insurance and was not employed by a corporation. We took the novel approach of going after the masseuse’s former employer. The former employer was aware of prior improper conduct by the massage therapist with at least two other women during massage sessions and terminated him yet failed to report him to the NC Board of Massage & Bodywork Therapy. In doing so, the perpetrator was allowed to continue to sexually assault our client.

Client was sexually abused while receiving massage therapy services at a facility. The business owner failed to conduct a proper background check on the employee prior to hiring. The owner also failed to verify that the employee’s massage therapy license was in good standings with the NC Board of Massage and Bodywork Therapy prior to hiring. The assailant had been terminated from two other massage facilities just months prior following similar complaints of sexual assault made by two other females.There was a pending investigation with the NC Board of Massage and Bodywork Therapy on the assailant for sexual misconduct that the business owner would have been made aware of if he had exercised due diligence in checking the employee’s license to practice massage therapy.

Construction Accident: Trench Collapse Death
Our 40-year-old client was installing underground water meters for a future gas station inside an excavated trench when the trench collapsed and buried him alive. Supervision and control of the overall construction project was neglected, and protective measures were not taken for the safety of the workers hired, resulting in extremely dangerous work conditions. The general contractor for the construction project subcontracted the out of state company that our client worked for, even though this company was not licensed to work in NC. Additionally, the decedents girlfriend tried to falsify a marriage to take a portion of the estate, from our client’s son. We proved her a fraud giving the clients son the full value of the estate. We recovered full 3rd party NC Workers Comp death benefits and went after the 3rd party contractor (who wasn’t our client’s employer) that caused the collapse.

Nursing Home Neglect Abuse: Damage Cap Exceeded
An 80-year-old man was admitted to a skilled nursing facility for rehabilitation following a brief hospitalization for aspiration pneumonia. The following day during a shift change, a nurse saw that he had fallen out of his bed, but she did not walk into the room to check on him. Instead, she went to the nurses’ station and told another nurse, who was in the middle of conducting a pill count, that the patient had fallen out of bed. That nurse also failed to stop what she was doing to check on the patient. Two to three minutes later the nurse went to the patient’s room to find him hanging from the cord of his nursing home bed control remote. He has no pulse. The scene following the discovery of the patient was chaotic, and no lifesaving emergency procedures were performed, and he was pronounced dead shortly after emergency medical technicians arrived on scene. The patient died in from asphyxiation due to strangulation when he became entangled in the cord for his nursing home bed control. In 2011, North Carolina imposed a statute N.C. Gen. Stat. § 90-21.19 that capped non-economic damages not to exceed $500,000.00 (which is currently valued at $656,730.00 due to the consumer price index). However, there is an exception when the defendant’s acts or failures, which are the cause of plaintiff’s injuries, were committed in reckless disregard of the rights of other or grossly negligent. The settlement of $800,000.00 exceeded the cap imposed due to the gross negligence and reckless disregard of the nursing staff. We call this a cap buster.

The defendant failed to reduce speed and rear ended their vehicle and pushed it into the vehicle in front of them causing a chain reaction. His treating physicians claimed it was likely an incidental finding and the lucencies appeared chronic in nature.
