Fail to Yield the Right of Way at an Intersection

Our client was traveling west on a motorcycle, came to a stop at a stop sign and was going to make a left turn. The defendant was traveling east, came to a stop at a stop sign and was going to make a right turn. Both drivers thought the other was allowing them to make the turn first. Both proceeded into the intersection and collided. The police officer could not determine fault. Our client suffered from knee abrasions, bilateral rib fractures, pneumothorax, a right shoulder fracture that required surgery and a right wrist fracture. The other drivers’ insurance carrier denied liability. We filed a lawsuit; the insurance company overturned their decision, and we recovered all applicable insurance coverage.

Motorcycle Accident

Our client was traveling on his motorcycle in excess of the speed limit when a vehicle pulled from a parking lot into his path causing a collision. Our client was ejected from the motorcycle and struck a utility pole. He passed away at the scene. The defendant driver left the scene of the accident and was later found at her home and charged with Felony Hit/Run causing death.  We overcame contributory negligence and recovered all available insurance coverage. Medical Malpractice Case Results

Angel of Death Medical Malpractice/Exceeded Cap on Damages

A massive dosage of insulin was intentionally administered to kill our very sick 60-year-old client who was on dialysis, heavily medicated, and suffering from renal failure. The nurse was prosecuted and convicted. At the time, NC had a damages cap of $656,730. We had to show punitive damages and achieved a cap buster, beating the cap of non-economic damages on med mal cases.

Medical Malpractice Overdose Death

Our 6-year-old client had issues wetting his bed. His parents consulted a doctor who prescribed Imipramine, a strong psychoactive medicine sometimes used for bed wetting with a known risk of cardiac side effects. Our client was playing on the playground at school and died in front of his sibling and classmates after suffering a cardiac arrest. The toxicology results showed the child was prescribed 9 times the recommended dosage for our client’s weight.

Birth Injury

Our 14-year-old client hid an unexpected pregnancy from her family and did not receive prenatal care until the 17th week. After a difficult delivery where the baby had the umbilical cord wrapped around its neck and a suction vacuum was used, the baby was born with significant developmental delays. This was a hotly contested case as the opposing counsel’s experts testified that the developmental delays were a result of bacterial exposure in the birth canal. This was a compromise settlement of a case that would be difficult to win at trial. We were able to secure a sizeable settlement, and the money went into a special needs trust to help with baby’s significant care needs.

Swimming Pool Electrocution

Our 11-year-old client was at swim practice when a utility pole fell near the pool at her swim club. The utility pole fell because it was in a state of disrepair. The massive electrical current jumped to the plumbing for the pool which was not properly grounded. The swimmers felt a charge in the water. When the lifeguard called the children out of the pool, or client used the metal ladder to exit and was electrocuted as her coach, peers and parents watched helplessly. We sued the utility company and the swim club.

Brake failure crushed hand

Our client was employed as a truck driver and sent to a distribution location to pick up two trailers. Once he arrived on the premises, he was attempting to connect the two trailers with a dolly. The trailer was parked on an incline and the brakes on the dolly failed causing the dolly to roll and crush our client’s hand between the dolly and the front trailer. Our client suffered a crushed hand injury that required multiple surgeries.

While on the job, our client shattered his ankle exiting an armored truck when he stepped down into a pothole that had been previously been reported to the business. The business, nor the property management company that was hired to maintain the parking lot, filled in the pothole despite being made aware of the hole and its deterioration. Our client was in the scope of employment helping with a fundraising event at a premises rented by her employer when she was injured. Our client was a passenger in a golf cart driven by a staff member when the driver lost control causing the golf cart to go down a hill, ejecting our client into a creek. Our 14-year-old client was visiting a friend’s house for a sleep over. The owner of the home kept a loaded rifle in a gaming area where the kids played. The homeowner’s grandson fired the loaded rifle at my client, shooting him in the right eye. He suffered an extensive ballistic injury to the right orbit and underwent right eye and nasal surgeries. The bullet is still lodged in his brain. We were able to get the claim accepted and the insurance company to pay their full policy limits.

Our client was violently attacked with a baseball bat by another customer while innocently shopping at a major retail chain. The assailant struck our client numerous times in the head and face after becoming agitated with a previous encounter with an employee.  Despite the assailant’s belligerent behavior throughout the store, store security failed to take any steps to protect or ensure the safety and security of our client or any of its other customers.

OB Labor and Delivery Negligence

Our pregnant client presented to a local hospital in labor. After 50 hours with little
progress, the baby began showing serious signs of distress. Our client requested a
cesarean section; however, one was not immediately called, and she continued to labor
into the next day. The baby was ultimately delivered in critical condition and required
resuscitation. Despite intensive medical efforts, her baby did not survive. Through litigation our client received $250,000.00 Medical Malpractice OB Labor and Delivery Negligence: $255,000 Our pregnant client went to a local hospital having contractions. The baby’s heart rate was showing signs of trouble, but instead of acting quickly, the doctor just kept having her change positions. She should have been given a C-section, but she was told to keep pushing. Her baby was born unresponsive and couldn’t be resuscitated. Without having to file a lawsuit, we were able to recover a settlement for the family.

Our client was shot at a motorcycle gang party.  The shooter was a previous gang member and had been communicating threats. Unfortunately, the host of the party did not take any security measures to protect guest.

Our client had made a delivery to an upstairs apartment unit. As she was walking down the stairs, she was holding the handrail and looking down at the steps since the stairwell was very dark. An oddly shaped cement block was at the bottom of the stairs, which our client could not see due to the poor lighting conditions, causing her to trip and fall.

While walking through the service department to the retail area of a car dealership, our client slipped and fell when he stepped in liquid on the floor. There were no warning devices alerting our client to the dangerous condition posed by the liquid on the floor. When our client fell, he twisted his right knee and suffered right knee pain and low back pain radiating into his left thigh. Our client received x-rays, an MRI, aquatic therapy, and injections.

Our client was sight-seeing in a NC mountain resort when she tripped on a broken section of sidewalk causing her to fall. When our client fell, she landed on her left side injuring her arm, and her face hit the sidewalk causing serious injury. At the time of the incident, our client was told by the medics assisting her that others had fallen and been injured in the same spot.

Sexual Abuse Case Results

$12.5 Million

North Carolina School of the Arts

In June 2024, Lanier Law Group secured a $12.5 million settlement for former high school students who suffered sexual abuse at the hands of teachers and administrators at an Arts School in Winston-Salem. Incidents of abuse alleged in the lawsuit dated as far back as the late 1960s to 2012. This result was made possible by filing the lawsuit under the SAFE Child Act. The SAFE Child Act is a historic North Carolina law that extended the statute of limitations for civil child sexual abuse lawsuits. It created a temporary two-year lookback window in 2020 and 2021 that allowed child sex abuse victims to step forward with claims over abuse that occurred years and decades ago.

This case went to trial, the jury awarded our clients $1.1 million dollars each in compensatory and punitive damages.

Leasing agent for apartment complex entered apartment and sexually abused our client while the mother was not at home.

A leasing agent for an apartment complex entered the apartment where our client resided and sexually molested our client, a 12-year-old little girl, while her mother was not at home.  The apartment complex failed to perform a proper background check prior to hiring the perpetrator.

Our client was a teenager with developmental disabilities placed in the care and custody of DSS after his legal guardian/grandmother lost her home to a house fire and was unable to care for him. Our client was placed in a group home where he was sexually assaulted by another minor living in the same group home. DSS failed in their duty to provide proper care and keep him safe from harm while residing in their facility.

Our client discovered as an adult that she had been secretively photographed and videotaped by her stepfather when she was a minor child while she was nude. The perpetrator was indicted by a grand jury with one count of production of child pornography to which he plead guilty.

Our client was groomed and sexually assaulted at 13 years old by a flight instructor.  The officer used alcoholic beverages to desensitize the minor.

Sexual Assault by Masseuse

During a massage session, our client was sexually assaulted by a massage therapist. The perpetrator digitally penetrated, forcefully kissed and ejaculated in front of our client. The masseuse did not have assets or insurance and was not employed by a corporation. We took the novel approach of going after the masseuse’s former employer. The former employer was aware of prior improper conduct by the massage therapist with at least two other women during massage sessions and terminated him yet failed to report him to the NC Board of Massage & Bodywork Therapy. In doing so, the perpetrator was allowed to continue to sexually assault our client.

Child on Child Assault on a Transport Van

A minor was sexually assaulted by another child while riding in a passenger van that was owned and operated by a non-profit corporation. The corporation’s purpose was to
provide quality professional treatment to children with serious emotional and behavioral
problems. Defendant’s employees were negligent in their custody, supervision, and
protection of our client, who was participating in a program and service provided by the
corporation. Through litigation, the case resolved for $250,000.

Sexual Assault on transport van

Our client was a minor with special needs, riding in a van to be transported to a youth mental health program. While on the bus, our client was sexually assaulted by another youth participating in the program.

Sexual Assault by Masseuse

Client was sexually abused while receiving massage therapy services at a facility. The business owner failed to conduct a proper background check on the employee prior to hiring. The owner also failed to verify that the employee’s massage therapy license was in good standings with the NC Board of Massage and Bodywork Therapy prior to hiring. The assailant had been terminated from two other massage facilities just months prior following similar complaints of sexual assault made by two other females.There was a pending investigation with the NC Board of Massage and Bodywork Therapy on the assailant for sexual misconduct that the business owner would have been made aware of if he had exercised due diligence in checking the employee’s license to practice massage therapy.

Our client was groped by a package delivery driver at her residence and we were able to secure a settlement from the global shipping company. The perpetrator plead guilty to
criminal charges of sexual battery and was sentenced in court. Through litigation, the case resolved for $175,000.

Construction Accident: Trench Collapse Death

Nursing Home Neglect Abuse: Damage Cap Exceeded

An 80-year-old man was admitted to a skilled nursing facility for rehabilitation following a brief hospitalization for aspiration pneumonia. The following day during a shift change, a nurse saw that he had fallen out of his bed, but she did not walk into the room to check on him. Instead, she went to the nurses’ station and told another nurse, who was in the middle of conducting a pill count, that the patient had fallen out of bed. That nurse also failed to stop what she was doing to check on the patient. Two to three minutes later the nurse went to the patient’s room to find him hanging from the cord of his nursing home bed control remote. He has no pulse. The scene following the discovery of the patient was chaotic, and no lifesaving emergency procedures were performed, and he was pronounced dead shortly after emergency medical technicians arrived on scene. The patient died in from asphyxiation due to strangulation when he became entangled in the cord for his nursing home bed control. In 2011, North Carolina imposed a statute N.C. Gen. Stat. § 90-21.19 that capped non-economic damages not to exceed $500,000.00 (which is currently valued at $656,730.00 due to the consumer price index). However, there is an exception when the defendant’s acts or failures, which are the cause of plaintiff’s injuries, were committed in reckless disregard of the rights of other or grossly negligent. The settlement of $800,000.00 exceeded the cap imposed due to the gross negligence and reckless disregard of the nursing staff. We call this a cap buster.

Nursing Home Neglect Abuse: Nursing Home Negligence

Our client was admitted to a rehabilitation nursing facility after being hospitalized for
pneumonia. He had dementia, and the facility knew he was a fall risk. One of the CNAs
repositioned him in bed and left the call light and bed cords lying across his stomach. She also failed to lower the bed. About an hour later, the CNA walked past his room and
noticed he was no longer in bed and could see he was on the floor on the other side of his bed because she could see his feet sticking out at the end of the bed. Instead of checking on him, she told a nurse at the nurses’ station that he had fallen and then left for another unit. The nurse didn’t go into the room right away, and when she finally did, she found our client unresponsive—strangled by the cords that had been left across him. He could not be resuscitated. We were able to exceed the North Carolina cap on damages with this settlement.
