Total & Permanent Disability Claims in North Carolina
Qualifying for Social Security Disability Benefits
In order to be eligible for Social Security disability (SSD) in North Carolina, you must have a total and/or permanent disability as defined by the Social Security Administration (SSA). SSD benefits are not provided for individuals who have suffered only a partial disability.
In other words, you must prove to the SSA that your condition:
- Prevents you from returning to your previous employment
- Prevents you from obtaining comparable employment/partial employment
- Has lasted or is expected to last at least 12 continuous months or is expected to result in death
If you have suffered a temporary total disability, you may be able to recover wage replacement benefits through your employer’s workers’ compensation insurance.

What Are Total & Permanent Disabilities?
Individuals who suffer total permanent disabilities may be eligible to receive permanent total disability (PTD) benefits for life if their condition does not improve.
For cases arising after June 24, 2011, the state defines “total permanent disabilities” as:
- Spinal cord injuries resulting in paralysis of the trunk, both arms, and/or both legs
- Amputation of both hands, arms, feet, or legs; loss of both eyes; or a combination thereof
- Severe closed head injuries and/or traumatic brain injuries (TBIs) or brain damage
- Second- or third-degree burns covering at least 33 percent of the body
