Determining Whether You Should Settle Your Workers’ Comp Claim

workers’ compensation claim can be resolved in several ways, including settlement and litigation. An experienced workers’ compensation lawyer can help you determine which avenue is appropriate for your situation. Should you choose to settle your claim, it is important to find a knowledgeable North Carolina workers’ compensation lawyer who can help you do so in an effective and favorable manner. There are many ways in which a person may choose to settle his or her claim, and some situations may even require litigation, so an experienced attorney can help you determine which of those ways is best suited for your specific needs and situation.

Types of Workers’ Comp Settlements

If you are pursuing a workers’ compensation claim in North Carolina, there’s more than one way to settle your case.

The different types of workers’ compensation settlements include:

  • Compromise settlement agreement: This type of settlement is also known as a “clincher” agreement. When you sign a clincher agreement, you give up any rights you might have to future workers’ comp benefits in exchange for a lump-sum payment.
  • North Carolina Industrial Commission Form 26A: This is a form filled out by your employer in which the employer admits that you received a permanent partial disability as a result of your job. If your claim is resolved through a Form 26A, your right to future medical compensation will end two years after your employer last pays you any compensation. If you believe you will need future medical compensation, you must apply to the Industrial Commission within two years, or your right to these benefits may be lost.

An experienced North Carolina workers’ compensation attorney at Lanier Law Group can provide you with the trusted legal guidance you need after being injured in the workplace. We truly wish nothing but the very best for our clients and are committed to helping them settle or litigate their claims in a way that best serves their interests.
